Code Compliance Department utilizes contractors to provide Public  
Nuisance Services and/or other abatement work need to clear  
properties of trash and debris. The scope of work can or will include  
fence repairs, pool coverings and possible window boarding up,  
when a property is identified as being in violation. These services  
shall be performed at specific vacant, abandoned or occupied  
properties, as designated by the Code Compliance Department.

The parking lot at 255 Enterprise Road is in need of milling and  
resurfacing. The asphalt is brittle and has been patched multiple  
times. Not proceeding with this budgeted FY25/26 project presents  
safety concerns for both the public and employees.

In 2023 The City was awarded a grant during appropriation sessions  
for design, engineering, and permitting to expand the capacity of the  
Eastern Wastewater Plant from 1.5 Million Gallons per Day to 3.0  
MGD. The City then advertised RFQ #25002 for 90 days in which the  
city received only one qualified response from Kimley Horn. This  
project is for design, engineering and permitting only and is included  
in the current rate study.

The funding for this request is budgeted for in the FY25/26 budget.  
Total for CWR is $3,035,582.74 and Fausnight $65,613.55 for a total  
of $3,101,196.29.  
Background:  
Work includes unforeseen overruns due to roadway conditions along  
with replacement of temporary pavement markings with permanent  
pavement striping (including white lines, yellow lines, turn  
arrows/messages and Reflective Pavement Markers and continuing  
to mill & resurface roadways as funds are available each Fiscal Year.  
The City continues working towards addressing the resurfacing  
needs Citywide based on the Pavement Condition Index of each  
roadway section. The impacts of COVID put a halt to milling &  
resurfacing, and our contractor is moving towards completion of prior  
& current roadway listings.  
CWR (fka P&S Paving, Inc.) is an approved vendor that the City is  
piggybacking off an existing contract with Voluisa County. The  
contract between the CWR and the City of Deltona is valid until  
March 6, 2028.  
Fausnight Stripe & Line is an approved vendor that the City is  
piggybacking off an existing contract with Seminole County. The  
contract between the Fausnight Stipe & Line and the City of Deltona  
is valid until August 28, 2026.

8. ORDINANCES AND PUBLIC HEARINGS:

The City of Deltona Code of Ordinances (the “City”) adopted Article  
VII, “Trap, Neuter, Release Program,” Chapter 14, “Animals,” within  
its General Ordinances; trap, neuter, release (“TNR”) programs can  
be an effective and humane way to stabilize the cat population with  
free spay or neuter surgeries for free roaming cats commonly  
referred to as community cats; the City Commission enacted a pilot  
TNR program via Ordinance 10-2020, to address concerns about  
feral cats in Deltona:

The Code Compliance Manager recommends approval of the Animal  
Ordinance Chapter 14 - Animals.

Ordinance No. 06-2026 updates Chapter 82 of the Land  
Background:  
Development Code to address small wireless facilities in accordance  
with Section 337.401(7), Florida Statutes, and applicable federal law.  
State legislation requires local governments to permit these facilities  
within the public rights-of-way and limits local regulation to objective,  
reasonable, and nondiscriminatory standards. The amendments  
establish procedures, timelines, and design standards to ensure  
compliance with state law while addressing public safety,  
infrastructure coordination, and visual impacts. The changes are  
procedural in nature, do not change land use or density, are  
consistent with the Comprehensive Plan. The Planning and Zoning  
Board reviewed the proposed ordinance at its regular meeting on  
April 29, 2026, and voted 7-0 to recommend approval by the Mayor  
and City Commission. At first reading, the City Commission voted  
7-0 to approve Ordinance No. 06-2026. Between first and second  
reading, staff revised Section 82-123 to clarify that compliance with  
the Florida Building Code and National Electrical Code shall apply as  
amended from time to time. Staff recommends approval at second  
and final reading.

Ordinance No. 20-2025 amends Section 70-30 and Section 110-814  
of the Land Development Code to add definitions and updated  
regulations for barndominiums, metal buildings, and storage  
containers. The amendments establish standards related to  
screening, metal buildings, and storage containers. The

amendments establish standards related to screening, materials,  
colors, height, and placement, and clarify where these structures are  
permitted. The changes are intended to provide clearer and more  
consistent standards for applicants and staff and improve  
compatibility with surrounding development. Staff finds the proposed  
amendments consistent with the Comprehensive Plan. The Planning  
and Zoning Board will hear the item at its regular meeting on May 20,  
2026. Staff will provide an update to the Commission regarding the  
Board’s recommendation. The ordinance is recommended for  
approval at first reading.

At the Regular Commission Meeting held on November 18, 2024  
Commissioner Dori Howington was appointed the City’s designee to  
sit on both Team Volusia’s Executive Committee and Board of  
Directors. This item is so the City Commission can appoint a  
replacement. Also, the appointed representative will need to fill out  
the attached Team Volusia Transfer of Investor Designee Form.

assistance to physically handicapped persons in lieu of the construction or use of  
ramps or other mechanical devices in order to comply with Florida law. If proper  
accommodations for handicapped access cannot be made at a particular public  
meeting venue pursuant to a timely written request under Section 286.26 F.S., the  
City Manager shall change the venue of that meeting to a location where those  
accommodations can be provided.  
DECORUM POLICY: The City of Deltona has a significant interest in conducting orderly and efficient  
public meetings, which includes preventing disruption, promoting civility, and preserving decorum. To  
that end, behavior which disrupts or impedes the efficient and orderly conduct of any public meeting,  
as determined by the Mayor, or presiding officer, or a majority of the City Commission, is not  
permitted. The Mayor, or presiding officer, or a majority of the City Commission, may interrupt, warn,  
or terminate a speaker’s statement when that statement is too lengthy, personally directed, abusive,  
obscene, irrelevant, or otherwise reasonably perceived to be a disruption to the fair and orderly  
progress of the discussion at hand. The Mayor, or presiding officer, or a majority of the City  
Commission, may also interrupt any part of the meeting to warn any individual that they are being  
disruptive or otherwise impeding the efficient and orderly conduct of the meeting. The Mayor, or  
presiding officer, or a majority of the City Commission, may require any individual to leave a public  
meeting for its duration if that individual is unable to observe this Policy after being warned. Should an  
individual be required to leave a meeting for violating this Policy, that person shall be escorted from  
Commission Chambers by a Volusia Sheriff’s Deputy.  
PUBLIC FORUM: Public Forum will begin at 6:00 PM at the start of each regular meeting and will  
conclude after 30 minutes. Prior to addressing the City Commission on any topic during a meeting,  
members of the public shall fill out and submit a “Request To Speak” form provided by the City Clerk.  
A form must be filled out for each item that the speaker wants to speak about. Members of the public  
shall speak only when recognized by the presiding officer and once at the podium, shall identify  
themselves by name, city of residence, and/or organizational affiliation of people addressing the City  
Commission. Public comments shall only be directed to the Chair of the meeting, and not toward any  
specific Commissioners, staff members, or another member of the public. Members of the public shall  
be limited to speaking only during “Public Forum” for issues not on the meeting agenda which is  
limited to three (3) minutes for each speaker. Public comments for items on the agenda may be  
commented on only after there is a motion and second by the City Commission and is limited to three  
(3) minutes for each speaker. Please be courteous and respectful of the views of others. Members of  
the City Commission shall not enter into discussion or respond to a citizen’s comments other than to  
give directions or to ask for clarification. However, individual Commissioners may choose to respond  
under the "City Commissioner Comments" portion of the meeting.  
CONSENT AGENDA: The Consent Agenda contains items that have been determined to be routine  
and non-controversial. If discussion is desired by any member of the City Commission, that item must  
be removed from the Consent Agenda and considered separately. All other matters included under  
the Consent Agenda will be approved by one motion. Citizens with concerns should address those  
concerns by filling out a "Request To Speak" form provided by the City Clerk prior to Consent Agenda  
items being pulled.
