DECORUM POLICY: The City of Deltona has a significant interest in conducting  
orderly and efficient public meetings, which includes preventing disruption,  
promoting civility, and preserving decorum. To that end, behavior which disrupts  
or impedes the efficient and orderly conduct of any public meeting, as  
determined by the Mayor, or presiding officer, or a majority of the City  
Commission, is not permitted. The Mayor, or presiding officer, or a majority of  
the City Commission, may interrupt, warn, or terminate a speaker’s statement  
when that statement is too lengthy, personally directed, abusive, obscene,  
irrelevant, or otherwise reasonably perceived to be a disruption to the fair and  
orderly progress of the discussion at hand. The Mayor, or presiding officer, or a  
majority of the City Commission, may also interrupt any part of the meeting to  
warn any individual that they are being disruptive or otherwise impeding the  
efficient and orderly conduct of the meeting. The Mayor, or presiding officer, or a  
majority of the City Commission, may require any individual to leave a public  
meeting for its duration if that individual is unable to observe this Policy after  
being warned. Should an individual be required to leave a meeting for violating  
this Policy, that person shall be escorted from Commission Chambers by a  
Volusia County Sheriff’s Deputy.  
PUBLIC FORUM: Public Forum will begin at 6:00 PM at the start of each regular  
meeting and will conclude after 30 minutes. Comments during Public Forum are  
limited to items of City business that are listed on the Agenda and/or items that  
are not listed on the Agenda. Comments regarding listed Agenda items will take  
place after discussion of each item. Please be courteous and respectful of the  
views of others. In order to address the Commission, citizens must fill out a  
public participation slip and give it to the Deputy City Clerk. All citizen comments  
are limited to 4 minutes and shall be addressed to the Mayor or the Commission  
as a whole. Members of the City Commission shall not enter into discussion or  
respond to a citizen’s comments other than to give directions or to ask for  
clarification. However, individual Commissioners may choose to respond under  
the "City Commissioner Comments" portion of the meeting.

Kathy Bryan, and Dot Bradley addressed the City Commission.  
Mayor Avila called for a recess at 6:21 p.m. and reconvened at 6:30 p.m.

Stacy Cantu with Halifax Urban Ministries Barracks of Hope Construction gave a brief  
presentation to include an Overview of Project, Funding Received, Site Plan-962  
Derbyshire Rd, Review of Costs, $25,000 Room Sponsorship, and a brief video.  
Motion by Commissioner McCool, seconded by Commissioner  
Avila-Vazquez, to for the City of Deltona to approve $25,000 for the  
Barracks of Hope Construction.

Presentation - Senator Tom Wright will present a check to the City of  
Deltona for the Fisher Wastewater Treatment Facility Plant Conversion in  
the amount of $1,500,000 and the Eastern Wastewater Treatment Facility  
Expansion - Sewer Improvement in the amount of $2,000,000. Funding  
was secured with assistance from Senator Tom Wright, Representative  
Webster Barnaby and Representative Tom Leek.

Federal Programs: R2P2, RTCA, CUPP & EDA Grant - Kimberly Castro,  
Project Manager (386) 8859.  
Strategic Goal: Economic Development  
The Commission, Interim City Manager, and staff discussed raising tax dollars,  
matching grant funding, budgeting, recent awarded grants, hazard mitigation, raising  
Elkcam Boulevard, grant application timelines, home elevations, new sidewalks along  
Elkcam Boulevard, pedestrian safety, an 80/20 cost split, previous septic conversion,  
innovation, leadership vision, grant projects, Lakeshore Drive, not starting over,  
advancing prior community visions, residents' support, taxes and assessments, the  
Justice 40 Area, flood mitigation, progressive materials, pervious surfaces, smart  
development, ecological considerations, grant applications, visioning sessions, and  
surface ground water.

Terri Ellis and Elizabeth Chavez addressed the City Commission.

After discussion, the Commission concurred to allow the Project Manager to  
apply for four grants, of which three are completely free and the fourth is at a 20%  
-25% cost.  
6. ORDINANCES AND PUBLIC HEARINGS:  
A.  
Public Hearing - Ordinance No.12-2023, to Amend Chapter 14- Animals,  
of the Code of Ordinances, at first reading and to schedule second  
reading for November 6, 2023 - Marsha Segal-George, City Attorney,  
(386) 878-8872.  
Strategic Goals: Internal/External Communications  
The City Attorney gave a brief explanation of the item and read the title of Ordinance  
No. 12-2023.  
The Commission and City Attorney discussed the Volusia County Sheriff's Office (VSO),  
adding temperature, inclement weather and guard dog permits to the ordinance, water  
or shelter, animals covered under the ordinance, enforceability, trespassing, property  
rights, animal safety, hurricanes and tropical storms, extreme temperatures, the noise  
ordinance, clearly defining language, ticketing, preventative ordinances, severe  
language, parameters, safeguards, stepping outside the law, working dogs,  
domesticated animals, animals being family, clean water, pet licensing, pet vaccinations,  
as well as the current registration process and fees.  
Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to  
adopt on first reading Ordinance No. 12-2023, with the addition of a  
temperature, inclement weather and guard dog permit added to the Code  
of Ordinance and to schedule a second and final reading for November  
6, 2023.  
Mayor Avila opened the public comments.  
Jesse Simmons, Jess Carrion, Terri Ellis, Elizabeth Chavez, Kathy Gallagher and Elbert  
Bryan addressed the City Commission.

The City Attorney read the title of Ordinance No. 12-2023 for the record.

The Commission discussed pet registrations, consequences, Code Enforcement's  
responsibilities, peaceful assembly, required animal tags, fines for non-compliance, and  
the Special Magistrate.

comments during the public forum other than to give directions or to ask for  
clarification. Please be courteous and respectful of the views of others. Personal  
attacks on Commission members, City staff or members of the public are not  
allowed, and will be ruled out of order by the Mayor.

10. CONSENT AGENDA: The Consent Agenda contains items that have been  
determined to be routine and non-controversial. If discussion is desired by any  
member of the City Commission, that item must be removed from the Consent  
Agenda and considered separately. All other matters included under the Consent  
Agenda will be approved by one motion. Citizens with concerns should address  
those concerns by filling out a public participation slip and giving it to the  
Deputy City Clerk prior to Consent Agenda items being pulled.  
Vice Mayor Bradford requested to pulled Item 10-A for discussion.  
Motion by Commissioner Avila-Vazquez, seconded by Vice Mayor  
Bradford, to approve Consent Agenda Item 10-B. The motion carried by

Request approval to purchase a transport unit with approved budgeted  
funds. - Fire Chief Bill Snyder, Fire Department (386) 575-6902  
Strategic Goal: Public Safety  
Fire Chief Snyder gave a brief explanation of the item and provided a correction to the  
cost.  
Mayor requested Fire Chief Snyder make the correction to the cost and forward that  
information to the City Commission.  
Motion by Vice Mayor Bradford, seconded by Commissioner McCool, to  
approve the purchase of a transport unit with approved budgeted funds  
based on the actual numbers. The motion carried by the following vote:

B.  
Request for approval of proposed changes to the By-Laws for the  
Affordable Housing Advisory Committee (AHAC) - Angelia Briggs,  
Housing & Community Development (386) 878-8614.  
Strategic Goal: Internal and External Communication  
Approved by Consent Agenda - to approve the changes to the AHAC  
By-Laws and extend the current terms of the Committee members to  
expire on December 31, 2023.  
11. CITY COMMISSION SPECIAL REPORTS AND REQUESTS:  
Commissioner Avila-Vazquez requested to work with Barb Girtman, Foundation to  
Freedom Domestic Violence, to have the domestic violence event at The Center as  
she requested and the Commission concurred.  
Commissioner Avila-Vazquez requested that staff work with the Volusia County  
Sheriff's Office to create a QR code for human trafficking and bring back the  
VSO's human trafficking event which was held in the past and the Commission  
concurred.  
Commissioner McCool stated there will be an informational session regarding flooding  
and she gave a brief overview of the TPO (Transportation Planning Organization)  
meeting.  
Vice Mayor Bradford requested to have the schools come in once a month to do  
the invocation and the Commission concurred.  
Vice Mayor Bradford reported about emails concerning meetings going into recess when  
there is an issue with the broadcast. She also reported that Lake Baton is a private  
subdivision and dedicated to the HOA (Homeowners' Association) with the exception of  
the public right away and noted that the City does not have the right to assist this private  
subdivision. Additionally, Vice Mayor Bradford reported that there is a home on Loblolly  
that is using a cut through on the lawn to avoid Howland Boulevard.  
Mayor Avila requested a special day where the Commission would help Habitat  
For Humanity and the Commission concurred.  
Mayor Avila requested on October 13th to light up Deltona City Hall with purple in  
support of not having domestic violence and the Commission concurred.  
12. CITY ATTORNEY COMMENTS:  
13. CITY MANAGER COMMENTS:  
The Interim City Manager stated he received a request from the City of Port  
Orange on behalf of the Volusia League of Cities Board of Directors to join in with  
a resolution against the fuel tank farm in Ormond Beach and the Commission  
concurred.  
14. CITY COMMISSION COMMENTS:  
Commissioner Avila-Vazquez discussed the domestic violence event, Discovery  
Elementary tour of City Hall, the Wig Out event, the October 12th CompStat Meeting,  
October 11th Sons and Daughters of Italy's Italian Heritage Month event, and residents  
parking in the right-of-way.  
Commissioner McCool discussed the Wig Out event and her health journey.  
Vice Mayor Bradford discussed Spooktacular, the Veterans Day event, and driving in the  
right-of-way.  
Mayor Avila discussed Commissioner and staff attendance during meetings, being  
nominated for an award from the 2023 Florida Latino Leaders, a potential Sister City  
Agreement, and his duty and obligation to report concerns brought forward by residents.
