In September 2023, the City of Deltona entered into an agreement with  
Ardurra Group, Inc. to evaluate the Theresa Basin due to the impacts of  
Hurricanes Ian & Nicole. Hurricane Ian in September 2022, released  
historic rainfall in a 24-period period. Reports from surrounding cities  
and counties recorded between 15-20 inches of rainfall, which

translated to a 500-year to 1,000-year storm event. Most City retention  
ponds and stormwater management facilities are designed for the  
25-year storm (8.5 inches in 24-hour) for open basin with positive outfall  
and 100-year (11.5 inches n 24-hour) for closed basin (land-locked).  
The Theresa Basin is the largest of the four (4) major watersheds in the  
City. The basin drainage is connected through a cascading system  
controlled by culverts and ditches connected in series with lakes and  
water bodies. The total basin area is about 35.9 square-miles (22,969  
acres) of which 30.6 square-miles is land area (85.2%) and 5.3  
square-miles (14.8%) are lakes and water bodies. The headwater of  
the basin starts in City of Lake Helen on the west side of Interstate I-4  
near Old Camp Road. The basin flows from northwest to southeast  
direction and enters City of Deltona near Sand Lakes north of Howland  
Blvd and east of Interstate I-4. From there, the basin flows southeast  
direction through a series of interconnected lakes starting at Three  
Island Lakes to Dupont Lake to Angela Lake and eventually to Theresa  
Lake south of Newmark Drive. From Theresa Lake, the flow is directed  
south through the Butler Chain of Lakes and eventually into Lake Doyle,  
which is the southern boundary of the basin. Lake Doyle discharges via  
an outfall system to Lake Monroe and ultimately into the St. Johns River.  
This presentation will provide the findings of the Theresa Basin -  
Preliminary Summary Report, dated April 30, 2026.

This is the 3rd Quarter Mid-Year budget amendment for Fiscal Year  
2025-2026. The Commission approved the annual budget for FY  
2025-2026 on September 22, 2025. This amendment is necessary to  
account for additional revenues, received funding, necessary  
expenditure for operations and capital outlay and improvements  
adjustments.

This is a request for the City Commission to approve the Master Fee  
Schedule that incorporates changes for Utilities, Building, Business  
Tax, Planning & Zoning, Impact Fees, Fire Inspections and  
Miscellaneous Fees for Fiscal Year 2027.

Resolution No. 2026-53 includes Exhibit "A", which lists the existing  
fees and all updates. Fees included in Exhibit "A" are part of the  
adopted budget. This revision updates the statutory changes required  
of the City. These City fees are actual pass-through costs for various  
City services, etc.  
The City uses a "Master Fee" Schedule to establish fees for a variety of  
services.

The funds required for this project are available in the FY 25/26 budget  
under 302652 650100 Project 03999 as approved by the City  
Commission for the required amount of $133,194.00 plus up to 10%  
contingency. This award is using the piggyback agreement contracts  
with piggybacks Sourcewell Contract Number: 031622-H21.  
Background:  
After meeting with our ECHO grant writer and ECHO staff to complete  
the application for the Keysville Park Improvement Project approved by  
the Commission under Resolution No. 2026-30, the City was informed  
that Keysville Park’s current ECHO grant (awarded in the early 2000’s)  
is not in compliance, as the original grant included artificial turf in the  
entrances of both the small and large dog areas. The item before you  
are to install artificial turf in the small and large dog areas  
($133,194.00) and will bring the City into compliance with the currently  
active ECHO grant.  
Finance will move the required funding from the Other Parks project  
03999 to the Keysville Project 03020.

The City has enacted ordinances and regulations to protect the health,  
safety, and welfare of its residents. The enforcement of such

ordinances and regulations may include the issuance of civil citations  
for violations. Article VIII, Section 2(b) of the Florida Constitution  
provides that municipalities “shall have governmental, corporate and  
proprietary powers to enable them to conduct municipal government,  
perform municipal functions and render municipal services,” and  
authorizes municipalities to exercise any power for municipal purposes  
except as otherwise provided by law. The City Attorney, TG Law, PLLC  
can prosecute, on behalf of the City, civil citations issued for violations  
of the ordinances and regulations of the City of Deltona in accordance  
with the terms of TG Law’s contract dated November 2, 2024.

The item before you is for parking lot improvements at Harris M. Saxon  
Community Center. This is an action item that was listed under the  
parks improvement project previously approved by the Commission  
under Resolution No. 2026-30. Scope of work is to include relocation,  
milling, and resurfacing which ultimately will provide additional parking.  
The pricing on the proposal piggybacks on Volusia County’s Asphaltic  
Concrete Supply and Placement contract ITB NO. 25-B-43JS. Vendor  
is under an active agreement for on-call professional services with the  
City.

8. ORDINANCES AND PUBLIC HEARINGS:  
A.  
HB 559 (2026), codified as Chapter 2026-78, Laws of Florida,  
authorizes the governing body of a municipality to enact ordinances  
relating to animal control or cruelty and increases the maximum  
available civil penalty effective October 1, 2026. The City of Deltona  
Code of Ordinances Chapter 14, “Animals” establishes rules and  
regulations as to the keeping of animals within the City providing for the  
public health, safety, and welfare of both animals and the residents.  
Background:  
The abandonment of animals constitutes a serious threat to animal  
welfare and creates concerns for public health and safety, including the  
risk of injury, disease, and nuisance conditions within the City of  
Deltona.  
9. ACTION ITEMS:

At the request of the Mayor an Add-On Item was added to the Regular  
Commission Meeting (RCM) agenda to discuss suspending  
enforcement of the age restriction portion of Ordinance No. 02-2026,  
micromobility devices. After review, there was no motion, first or  
second made on this item. This is to confirm the unanimous vote taken  
at the RCM on August 3, 2026.

wishes to attend. The City is not permitted to provide the use of human physical  
assistance to physically handicapped persons in lieu of the construction or use of  
ramps or other mechanical devices in order to comply with Florida law. If proper  
accommodations for handicapped access cannot be made at a particular public  
meeting venue pursuant to a timely written request under Section 286.26 F.S., the  
City Manager shall change the venue of that meeting to a location where those  
accommodations can be provided.  
DECORUM POLICY: The City of Deltona has a significant interest in conducting orderly and efficient  
public meetings, which includes preventing disruption, promoting civility, and preserving decorum. To  
that end, behavior which disrupts or impedes the efficient and orderly conduct of any public meeting, as  
determined by the Mayor, or presiding officer, or a majority of the City Commission, is not permitted.  
The Mayor, or presiding officer, or a majority of the City Commission, may interrupt, warn, or terminate  
a speaker’s statement when that statement is too lengthy, personally directed, abusive, obscene,  
irrelevant, or otherwise reasonably perceived to be a disruption to the fair and orderly progress of the  
discussion at hand. The Mayor, or presiding officer, or a majority of the City Commission, may also  
interrupt any part of the meeting to warn any individual that they are being disruptive or otherwise  
impeding the efficient and orderly conduct of the meeting. The Mayor, or presiding officer, or a majority  
of the City Commission, may require any individual to leave a public meeting for its duration if that  
individual is unable to observe this Policy after being warned. Should an individual be required to leave a  
meeting for violating this Policy, that person shall be escorted from Commission Chambers by a  
Volusia Sheriff’s Deputy.  
PUBLIC FORUM: Public Forum will begin at 6:00 PM at the start of each regular meeting and will  
conclude after 30 minutes. Prior to addressing the City Commission on any topic during a meeting,  
members of the public shall fill out and submit a “Request To Speak” form provided by the City Clerk. A  
form must be filled out for each item that the speaker wants to speak about. Members of the public  
shall speak only when recognized by the presiding officer and once at the podium, shall identify  
themselves by name, city of residence, and/or organizational affiliation of people addressing the City  
Commission. Public comments shall only be directed to the Chair of the meeting, and not toward any  
specific Commissioners, staff members, or another member of the public. Members of the public shall  
be limited to speaking only during “Public Forum” for issues not on the meeting agenda which is limited  
to three (3) minutes for each speaker. Public comments for items on the agenda may be commented  
on only after there is a motion and second by the City Commission and is limited to three (3) minutes  
for each speaker. Please be courteous and respectful of the views of others. Members of the City  
Commission shall not enter into discussion or respond to a citizen’s comments other than to give  
directions or to ask for clarification. However, individual Commissioners may choose to respond under  
the "City Commissioner Comments" portion of the meeting.  
CONSENT AGENDA: The Consent Agenda contains items that have been determined to be routine  
and non-controversial. If discussion is desired by any member of the City Commission, that item must  
be removed from the Consent Agenda and considered separately. All other matters included under the  
Consent Agenda will be approved by one motion. Citizens with concerns should address those  
concerns by filling out a "Request To Speak" form provided by the City Clerk prior to Consent Agenda  
items being pulled.
