4. PUBLIC FORUM: Public comments shall be limited to items on the agenda and
shall not exceed four minutes. Please be courteous and respectful of the views of
others. Personal attacks on Commission members, City staff or members of the
public are not allowed, and will be ruled out of order by the Mayor.
5. BUSINESS:
A.
Request for approval of Mr. Dale “Doc” Dougherty’s proposed City
Manager employment agreement - City Attorney Marsha Segal-George,
Human Resources Director Floris Johnson and Commissioner Heriot.

Vice Mayor arrived at 5:31 p.m.
The City Attorney gave a brief explanation of the item.
Mayor Avila asked Commissioner Heriot to explain the changes and Commissioner Heriot
replied there were a lot of little changes but, the most substantial changes were the change
from 3% annual increase to 4%, the removal of Section 4, adding language to the
indemnification clause, and changes to the insurance contributions to an FSA (Flexible
Spending Account).
Vice Mayor asked if Commissioner Heriot was happy with the contract and Commissioner
Heriot replied very happy, this is a manageable contract.
Motion by Vice Mayor JodyLee, seconded by Commissioner McCool, to
approve the City Manager employment agreement as presented.
Mayor Avila opened the public comments and Edwin LaSanta, Elbert Bryan, Richard
Bellach and Tara D'Errico addressed the City Commission.
The motion carried by the following vote:

6. CITY MANAGER COMMENTS:
Vice Mayor called Point of Order, he wanted to talk about something because there is
something going around about the IRS.
Mayor Avila asked for clarification if the Commission can talk about anything other than
what is on the agenda and the City Clerk replied no.
Mayor Avila called Vice Mayor out of order.
