7. CONSENT AGENDA:  
A.  
The purpose of the Investment Policy is to set forth the investment  
objectives and parameters for the management of the funds of the City  
of Deltona. This policy is designed to ensure the prudent management  
of public funds, the availability of operating and capital funds when  
needed, and an investment return competitive with comparable funds  
and financial market indices. This policy complies with Section  
218.415, Florida Statutes, and applies to all cash and investments held  
or controlled by the City, except for the City’s Pension Funds and funds  
related to the issuance of debt where there are other existing policies  
or indentures in effect.  
Background:  
In addition, this policy focused on compliance with Florida State  
Statutes that govern the investment of public funds, as well as on  
inclusion of current best practices as recommended by the Government  
Finance Officers Association (GFOA) and the Association of Public  
Treasurers of the United States and Canada (APT US&C). Controls  
and safeguards that have historically been in place remain.  
Recommendations were designed to improve and increase the clarity  
of the policy. As such, the Operating investment policy has been broken  
out from the Deferred Compensation Plans investment policy, and both  
now stand on their own.  
The revisions presented in this policy have been fully reviewed and  
recommended for approval by Chandler Asset Management, LLC.  
They are the city's investment advisors related to the city's investment  
portfolio.  
B.  
Consideration will allow the City of Deltona to participate in the  
FLCLASS investment pool and fund investment accounts according to  
the City’s previously approved investment policy.  
Background:  
Under Florida Statute Sec. 218.415, local governments of the State of  
Florida may adopt written investment policies to allow investment and  
reinvestment of any surplus public funds in their control or possession in  
the Local Government Surplus Trust Fund or any intergovernmental  
investment pool authorized pursuant to the Florida Interlocal Act, FS  
§163.01 via Resolution. Resolution No. 2020-59 authorizes  
participation in local government investment pools. The proposed  
revision to the investment policy under consideration as part of  
Resolution No. 2025-153 maintains this as an authorized investment  
option.  
The City currently participates in 2 intergovernmental pools, Florida  
Prime and FLSAFE, which were previously approved by the City of  
Deltona City Commission. Adding FLCLASS will help diversify our  
investments among the pools. The 3 pools currently have a 30-day yield  
of between 4.03% - 4.27%, all with daily liquidity. Staff determine the  
cash needs for operations and upcoming capital needs and invest the  
remaining funds among the pools and authorized investments.

The City of Deltona submitted several flood mitigation projects to  
Volusia County’s Transform386 program. The project known as Sweet  
Gum Lake Flood Mitigation project proposes to have a permanent  
stormwater pump station and infrastructure installed on City owned  
property - Tract N, Deltona Lakes Unit 20. This project will extend the  
infrastructure on Pace Court to connect to the existing infrastructure on  
LeLand Drive.  
Background:  
The City’s application committed a 50% cost share of the project, which  
is estimated to be $919,520 of the $1,839,040 anticipated total project  
cost.  
D.  
The City of Deltona submitted several flood mitigation projects to  
Volusia County’s Transform386 program. The project known as  
Elkcam Boulevard at Lake Helen Osteen Road - Flood Mitigation  
Project proposes to improve the stormwater at this intersection.  
Background:  
The City’s application committed a 50% cost share of the project, which  
is estimated to be $422,787.50 of the $845,575 anticipated total  
project cost.  
E.  
The City of Deltona submitted several flood mitigation projects to the  
Florida Division of Emergency Management, including four properties  
for potential home elevation. FDEM will fund 75% of the elevation  
costs, while the property owners must fund the remaining 25%. It  
warrants mentioning that these homes were damaged by Hurricanes  
Ian, Nicole & Milton (repetitive damage claims).  
Background:  
This agreement is a reimbursement program with the City of Deltona is  
the applicant and sub-recipient; the City will need to have funding  
available to pay for the elevation cost estimate of $1,167,979 and  
submit for reimbursement draws with FDEM.  
Since the application submittal, two property owners have decided to  
no pursue property mitigation on their homes. Therefore, the overall  
final project cost is estimated to be less than $1,167,979. Property 1  
(Jeanniton Lane) is a home elevation estimated at $450,000 of which  
the property owner must secure 25% or $112,500, whereby the final  
total cost of the project to be funded and reimbursed is $337,500.  
Property 2 (Kumpula Drive) is an acquisition & demolition with an  
estimated cost of $685,000 of which $171,250 would be paid by the  
City and not eligible for reimbursement. This property upon acquisition  
& demolition with the title transferred to the City of Deltona. The  
property shall remain as vacant land or be used for a future stormwater  
improvement project. The estimated cost to the City of Deltona for  
these two projects is $171,250.  
F.  
Due to the impacts of Hurricane Milton, Ian & Nicole several homes in  
Deltona were flooded and in some instances repetitive flooding  
impacts. Pegasus Engineering and the City were able to present an  
application to the Division of Emergency Management (FDEM) for  
consideration under HMGP. HMGP is a FEMA funded program that is  
administered on behalf of FEMA through FDEM.  
Background:  
The City has an agreement with FDEM to proceed on behalf of the  
residents for flood mitigation of their properties. Pegasus  
Engineering’s work effort will include, but not limited to, procurement  
process for home elevations; conduct coordination meeting with the  
City and property owners; assist in the RFP process; provide guidance  
for the selection of the elevation contractor; prepare & submit quarterly  
reports; assist the City regarding pay request submittals; prepare &  
submit reimbursement requests to FDEM; and review final deliverables  
for Grant Compliance.  
HMGP applications are typically a 75/25 cost share, the funding paid to  
Pegasus Engineering may be used towards the City’s 25% cost share.  
G.  
This is the Capital Project budget amendment for Fiscal Year  
2025-2026. The Commission approved the annual budget for FY  
2025-2026 on September 22, 2025. This amendment is necessary to  
account for additional capital funding and necessary expenditure for  
operations and capital outlay and improvements.  
Background:  
H.  
Staff conducted a bid for the complete replacement of all exterior  
windows and doors at Deltona City Hall located at 2345 Providence  
Blvd. $440,575.00 dollars were budgeted for this project including a  
Department of Energy Efficiency Grant of $139,630.00 dollars. The  
funds for the DOE Grant must be expended by January 21, 2027. Four  
complete and competitive bids were received. The low bidder on this  
project is Property Renovations & Construction LLC whose bid came in  
at $679,350.00 dollars. A budget amendment of $274,775.00  
(including $36,000 dollars) for window shades is required to ensure  
appropriate funding. Staff recommend award of Bid #26004 to  
Property Renovations & Construction, LLC for an estimated project  
total of $715,350.00.  
Background:  
I.  
The City of Deltona, Florida has provided notice of its intent to use the  
uniform method of collecting non-ad valorem assessments, pursuant to  
section 197.3632, Florida Statutes, for properties located within the  
jurisdictional boundaries for the City, to fund the cost of providing fire  
rescue services for the Fiscal Year beginning on October 1, 2026, and  
continuing until discontinued by the City.  
Background:  
This annual Fire Service Assessment is expected to pay a significant  
percentage of the annual cost for our fire department’s capital and  
service availability. This is an annual process, in which the staff will go  
through several public meetings and hearings before we bring this back  
to the Commission as part of the annual budgetary process.  
The Fire Service Assessments for each property parcel will be based  
on a benefits and burdens analysis recommended by our consultant  
Benesch. The City Commission will have to carefully consider their  
analysis. A Fire assessment was approved as lawful by the Circuit  
Court in 2015. The rates will be associated with the cost of continually  
making fire protection services and facilities available every day for all  
parcels within the City. This concept has also been approved by the  
Florida Supreme Court.

This Resolution authorizes the City Manager or his designee to execute  
a settlement agreement extinguishing all claims made by John Peters  
in the case styled as John Peters v City of Deltona and identified by  
Case Number 2023-11849-CIDL including a Non-Disparagement  
Agreement in favor of the city.

8. ORDINANCES AND PUBLIC HEARINGS:

On April 21, 2025, the City Commission approved Resolution No.  
2025-51, creating the Ordinance Review Committee provided for in  
Section 1-17 of the Code of Ordinances for the purpose of engaging in  
a comprehensive review of the Code of Ordinances of the City of  
Deltona. The Committee will consist of 7 appointments and will work  
with a professional consultant to facilitate the review of the City’s Code  
of Ordinance and prepare proposed revisions for consideration by the  
City Commission.  
Background:  
On November 17, 2025, the Commission chose their appointments to  
the Ordinance Review Committee except for the Mayor. The remaining  
applicants are: Heidi Barker, Elizabeth Bertholf, Dorothy Bier, Elizabeth  
Chavez, Adrian Crutchfield, Brandon Hart, Christopher Leon, Jennifer  
Madewell, Mary Robison, Jennifer Welker and Brandy White.  
B.  
City Commission directed Staff during the budget process to go out to  
bid for a Forensic Audit. The Commission approved as part of the  
Fiscal Year 2025 - 2026 budget an amount of $500,000 for this audit.  
Background:  
Staff developed a scope of work as shared with Commission from the  
Cities of Belle Glade and Apopka an issued RFP 25020 on September  
1, 2025. Due to the overwhelming number of questions received (59 in  
total), the original RFP Due Date of October 13, 2025, had to be  
extended until October 30, 2025, to allow for time to respond.  
The City only received one responsive bid that met the requirements  
and qualifications of this solicitation and that was from Carr, Riggs &  
Ingram based out of Miramar Beach, FL.  
To accept the bid, additional funds would be required in the amount of  
$825,000 to be allocated towards this initiative.

The City of Deltona adopted Ordinance 29-2025 imposing a temporary

moratorium on June 30, 2025. On November 4, 2025, the attorney for  
Howland Holdings Group LLC. sent correspondence to the City alleging  
that the City’s moratorium is prohibited pursuant to SB 180. The City  
Attorney’s office is seeking direction from the City Commission if action  
is required.

assistance to physically handicapped persons in lieu of the construction or use of  
ramps or other mechanical devices in order to comply with Florida law. If proper  
accommodations for handicapped access cannot be made at a particular public  
meeting venue pursuant to a timely written request under Section 286.26 F.S., the  
City Manager shall change the venue of that meeting to a location where those  
accommodations can be provided.  
DECORUM POLICY: The City of Deltona has a significant interest in conducting orderly and efficient  
public meetings, which includes preventing disruption, promoting civility, and preserving decorum. To  
that end, behavior which disrupts or impedes the efficient and orderly conduct of any public meeting, as  
determined by the Mayor, or presiding officer, or a majority of the City Commission, is not permitted.  
The Mayor, or presiding officer, or a majority of the City Commission, may interrupt, warn, or terminate  
a speaker’s statement when that statement is too lengthy, personally directed, abusive, obscene,  
irrelevant, or otherwise reasonably perceived to be a disruption to the fair and orderly progress of the  
discussion at hand. The Mayor, or presiding officer, or a majority of the City Commission, may also  
interrupt any part of the meeting to warn any individual that they are being disruptive or otherwise  
impeding the efficient and orderly conduct of the meeting. The Mayor, or presiding officer, or a majority  
of the City Commission, may require any individual to leave a public meeting for its duration if that  
individual is unable to observe this Policy after being warned. Should an individual be required to leave a  
meeting for violating this Policy, that person shall be escorted from Commission Chambers by a  
Volusia Sheriff’s Deputy.  
PUBLIC FORUM: Public Forum will begin at 6:00 PM at the start of each regular meeting and will  
conclude after 30 minutes. Comments during Public Forum are limited to items of City business that  
are listed on the Agenda and/or items that are not listed on the Agenda. Comments regarding listed  
Agenda items will take place after discussion of each item. Please be courteous and respectful of the  
views of others. In order to address the Commission, citizens must fill out a public participation slip and  
give it to the Deputy City Clerk. All citizen comments are limited to 3 minutes and shall be addressed to  
the Mayor or the Commission as a whole. Members of the City Commission shall not enter into  
discussion or respond to a citizen’s comments other than to give directions or to ask for clarification.  
However, individual Commissioners may choose to respond under the "City Commissioner  
Comments" portion of the meeting.  
CONSENT AGENDA: The Consent Agenda contains items that have been determined to be routine  
and non-controversial. If discussion is desired by any member of the City Commission, that item must  
be removed from the Consent Agenda and considered separately. All other matters included under the  
Consent Agenda will be approved by one motion. Citizens with concerns should address those  
concerns by filling out a public participation slip and giving it to the Deputy City Clerk prior to Consent  
Agenda items being pulled.
