BACKGROUND:
Background
At the June 16, 2025, Regular City Commission Meeting, the City Commission voted to
negotiate appropriate documents with Developer pursuant to which Developer will develop and use the Property to create a post home for Sgt. David G. Ledgerwood American Legion Post 255. The City and Post have negotiated the terms of the Ground lease and a Master Development Agreement to govern the use, development, and management of the Property, in accordance with Section 2-202 (e) Code of Ordinance the following principal terms and conditions:
• The term of the ground lease shall be 49 years, commencing on the effective date as defined in the Agreements.
• The annual rent to be paid by the lessee shall be $10.00 per year , subject to adjustments as set forth in the Agreements.
• The Lessee shall use the Property for the purpose of construction and operation of a Post home for Sgt. David Ledgerwood American Legion Post 255 whose principal address is 1921 Evard Ave, Deltona, Florida 32738, and for no other purpose without prior written consistent of the City.
• Lessee shall be responsible for all development, maintenance, and operational costs associated with the Property during the lease term.
• Such other terms and conditions as set forth in the Agreements and as may be approved by the City.
