BACKGROUND:

Background

On June 29, 2021, the Governor of Florida signed House Bill 403 into law, establishing Florida Statute 559.995, titled “Home-based businesses; local government restrictions.” This statute significantly limits the authority of local governments to regulate home-based businesses by preempting such regulation at the state level.

 

Under F.S. 559.955, local governments are prohibited from regulating or restricting home-based businesses differently than other businesses within the same jurisdiction, except as specifically allowed in the legislation. The statute ensures that home-based businesses that comply with certain operational standards are granted the same rights and protections as any other lawful business.

 

As a result of this legislative change, staff has reviewed and updated local codes and policies to ensure alignment and compliance with the requirement set forth in F.S. 559.955.
