BACKGROUND:
Background
The applicant is seeking a Variance from the Land Development Code, Section 110-806, regarding the current 6-foot fence in the side street yard. The fence was a code violation in November 2022, and has been an ongoing case with Code Compliance with two (2) extensions to allow the applicant to apply for a fence permit and then to apply for a Variance.
The applicant was approved for fence permit on April 10, 2023, at this time the applicant was supplied with a survey depicting the 5-foot fence and 6-foot fence allowances on the property. The fence was up prior to a fence permit being pulled. The 2023 fence permit states it is a repair and reinstall, although the fence that was installed sometime in 2022 with a different footprint.
On May 15, 2024, the Planning and Zoning Board unanimously recommended the City Commission deny Resolution No. 2024-19, for the Variance at 402 Bali Terrace.
